1. Contract conclusion

The contract is concluded upon verbal or written registration by the contractual partner, hereinafter referred to as the ‘customer’. In the case of group programmes, this registration applies to the entire group and the claims arising from the booking. By registering, the customer accepts our General Terms and Conditions. The booking becomes binding as soon as the ordered service is confirmed verbally, in writing or by email by FF STADTFÜHRUNGEN e. K. (address see above), hereinafter also referred to as ‘FF’ or ‘organiser’. All participants undertake to comply with the applicable Cologne city regulations.

2. Prices and payment

The prices quoted are final prices including statutory value added tax. The total price of the order is due without deduction within seven days of conclusion of the contract after invoicing. In exceptional cases, the customer may also pay the tour guide directly in cash.

3. Services

The scope of the contractual services is determined by the service descriptions in the offer. Any deviations from this require written confirmation.

4. Cancellation by customer and rebooking for booked group tours

The customer may withdraw from the contract before the start of the event by sending a written declaration to FF. If the customer withdraws from the contract or fails to attend an agreed appointment, the organiser may demand reasonable compensation. The flat-rate cancellation and rebooking fees are as follows:

• More than 42 days before the start of the event: €30 (gross) processing fee
• 42 to 21 days before the start of the event: €50 (gross)
• from the 20th day before the start of the event: 50% of the price
• from the 14th day before the start of the event: 70% of the price
• from 48 hours before the start of the event or no-show: 100% of the price

The tour guide will wait for a maximum of 30 minutes at the agreed meeting point, unless otherwise agreed. For public tours and sales via KölnTicket, the terms and conditions

5. Rücktritt und Kündigung durch FF STADTFÜHRUNGEN e. K.

Der Veranstalter kann in folgenden Fällen vom Vertrag zurücktreten:

• bei Einwirkung höherer Gewalt
• bei plötzlicher Krankheit eines Guides
• wenn der Kunde oder die Teilnehmer/innen einer Gruppe des Kunden die Durchführung der Veranstaltung, ungeachtet einer Abmahnung, nachhaltig stört, oder wenn er sich in solchem Maß vertragswidrig verhält, dass die sofortige Aufhebung des Vertrages gerechtfertigt ist.

6. Gewährleistung und Haftung

FF Stadtführungen e. K. haftet als Veranstalter für die gewissenhafte Vorbereitung der Veranstaltungen, die sorgfältige Auswahl und Überwachung der Leistungsträger, die Richtigkeit der Leistungsbeschreibung und die ordnungsgemäße Erbringung der vertraglich vereinbarten Leistung. Der Veranstalter haftet nicht für Leistungen, die als Fremdleistungen anderer Leistungsanbieter vermittelt werden (z.B. Touren anderer Anbieter, gastronomische Leistungen, Museums- oder Ausstellungsbesuche, Bahn-, Bus- oder Taxifahrten etc.) oder andere Fremdleistungen. FF übernimmt keine Haftung für seitens der Teilnehmer eigenverantwortliche Sach- und Körperschäden und den Verlust mitgeführter Gegenstände. Eine Haftung für mögliche Unfälle ist ausgeschlossen. Der Kunde oder die TeilnehmerInnen einer Gruppe sind verpflichtet, mögliche Mängel unverzüglich FF mitzuteilen.

7. Datenschutz

Der Kunde ist damit einverstanden, dass die für die Abwicklung der vereinbarten Leistung zur Verfügung gestellten Daten auch weiterhin vom Veranstalter für die Kundenbetreuung verwendet werden. Diese Daten werden im Sinne der Europäischen Datenschutz-Grundverordnung (DSGVO) verarbeitet und nicht an Dritte weitergegeben.

8. Salvatorische Klausel

Sollten eine oder mehrere Bestimmungen dieser Vereinbarung ganz oder teilweise unwirksam sein oder werden, so wird hierdurch die Gültigkeit der übrigen Bestimmungen der Vereinbarung nicht berührt.

9. Gerichtsstand

Gerichtsstand ist der Geschäftssitz des Veranstalters. Auf dem Vertrag findet deutsches Recht Anwendung.
